EO6 sues IGP and home minister

Dr Jeyakumar (in white shirt) and the other five after they filed their suit. — Picture by Choo Choy MayKUALA LUMPUR, March 23 — Dr Michael Jeyakumar and five other members of Parti Sosialis Malaysia (PSM) are suing the Inspector-General of Police, Deputy IGP and home minister for their 28-day arrest under the Emergency Ordinance (EO) in July last year.
The claims made by the six plaintiffs, otherwise known as the “EO6”, are for wrongful arrest and false imprisonment, assault and battery, malicious prosecution, particulars of malice/absence of reasonable cause or grounds, abuse of process, and misfeasance in public office and breach of statutory duty.

Also named in the suit were 78 other police officers involved in their arrests.

“We are doing this because we want the police in this country to work in a professional capacity,” Dr Jeyakumar told reporters today outside the Kuala Lumpur High Court.

“The police were acting for political reasons, which were to smear Bersih’s name. They used us, and that is wrong.

“If we let this slide, they might do it a second or third time to other Malaysians,” the Sungai Siput MP said.

But, he added, that many of the policemen named in the suit were sympathetic, and the real problem lay in their leaders as well as the home minister.

“We’ve made several attempts to hold a dialogue with the home minister. We wanted to ask him who told him we had weapons in the bus and that we were planning an attack on a police station in Sungai Siput. We just wanted to know who spread that misinformation,” he said.

“Because they refuse to discuss this with us, we have no choice but to bring this to court.”

The lead counsel for the plaintiffs is Edward Bon Tai Soon.

On October 28 last year, Dr Jeyakumar and five other PSM members were given a discharge not amounting to acquittal for allegedly owning subversive papers and gathering illegally ahead of the Bersih rally that took place in July.

On September 19, police dropped all charges against 30 PSM activists arrested for waging war against the Yang di-Pertuan Agong, including the six who were detained under the EO.

This came just days after Prime Minister Datuk Seri Najib Razak announced reforms to security and press laws, including the repeal of the Internal Security Act (ISA) and the lifting of three Emergency Declarations.

In place of the ISA, Najib had announced the drafting of two new laws to curb terrorism in the country, much like the Patriot Act in the US, which was enacted after the 9/11 terrorist attacks.

Police detained the 30 PSM activists in Penang during the party’s “Udahlah Bersara” campaign and their arrests were later said to be linked to the government’s pre-Bersih rally clampdown.

They were then accused of attempting to revive communism and wage war against the King when T-shirts with the images of Marxist revolutionary leader Che Guevara and Malayan communist figures were found in their possession.

The “EO6”, including Dr Jeyakumar, were later imprisoned for 28 days under the EO, which allows for detention without trial for up to 60 days.

The other five were PSM deputy chairman M. Sarasvathy, central committee members Choo Chon Kai and M. Sugumaran, Sungai Siput branch secretary A. Letchumanan and Youth chief R. Saratbabu.

Their subsequent release on July 29, 20 days after Bersih 2.0’s tumultuous rally which saw thousands gathered in the capital to push for electoral reforms, was claimed to be a result of public pressure and negative publicity in the foreign media after the protest.

I CARE: 1 more TAX for the poor!!











Dr. Kumar gave an explanation about government’s 1 Care to a group of PSM members at the Pustaka Kiri. Though lot of read in the media about 1 Care, his explanation made more sense in the both social and economic impact on the masses especially the poor and private sector doctors as well as the ideological dimension.

In a glance I CARE looks good, take a second look and one might fear on the honesty of the assigned doctors whether his interest his to get more allocation from NHFA or the health of the patient. If we take a deeper look, then one would understand how the government plans to create monopoly – all money, about 30 million would be given away to one company or agency called NHFA – can we trust their efficiency …hmm hmmm!!!

At the end, quality of health system would be jeopardized and the masses had to pay one more tax under I CARE after GST that is sure to come if BN wins in the next election. Already the masses are suffering, why the government keep burdening them with all these taxes. If only the government is not corrupted and that don’t waste money on arm deals and other wasteful projects, they could provide free health care to the public, said Kumar.

Tuntutan Pekerja: Akta Gaji Minima RM1500

Berapa BN nak umum?

Perjuangan menuntut Gaji Minima untuk warga pekerja di Malaysia akhirnya Nampak telah mula membuahkan hasil. Pada Julai 2011, Kementerian Sumber Manusia (KSM) meluluskan Akta Majlis Perundingan Gaji Negara untuk menentukan jumlah Gaji Minima kepada pekerja.

Setelah 10 bulan, Menteri Sumber Manusia, Dato’ Dr. S. Subramaniam telah mengumumkan bahawa satu kadar gaji minima telah diputuskan dan jumlahnya akan diumumkan dalam bulan Mac 2012. Pada 21 Mac 2012 Perdana Menteri Dato Seri Najib Razak pula mengatakan bahawa akan membuat pengumuman tentang Gaji Minimum pada 1 Mei iaitu pada Hari Pekerja. Kini persoalannya, berapakah jumlah gaji minima yang akan diumumkan ?

Banyak laporan mengatakan bahawa jumlah gaji minima yang akan diumumkan adalah dalam lingkungan RM800-RM900. Ini mungkin benar kerana JERIT mendapati pihak majikan sedang memberi tekanan yang hebat kepada pihak Kerajaan untuk tidak melaksanakan gaji minima dan sekiranya dilaksanakan ia adalah pada kadar yang terendah.


Namun JERIT menuntut Gaji Minima RM1500. Mengapa ?

Jika dilihat kedua-dua jadual di atas, harga barangan asas di Malaysia sudah pasti telah meningkat secara mendadak. Perbelanjaan yang ditunjukkan di atas untuk seorang pekerja yang mempunyai keluarga sederhana. Perbelanjaan lain seperti bil Astro, bil telefon, bayaran kelas tuisyen, cukai tanah, cukai pintu, penyelenggaraan kenderaan, kecemasan untuk klinik/hospital belum dimasukkan lagi.


Maka, Tuntutan pekerja RM1500 adalah relevan kerana:

1.Pekerja adalah asset utama negara, tanpa mereka tiada keuntungan. Mereka menyumbang pendapatan perkapita RM26 420 setahun untuk pendapatan negara setahun (bersamaan dengan RM 2201 per kapita sebulan). Apa salahnya menetapkan RM1500 sebagai Gaji Minima?
2.Untuk pekerja dapat menampung kos hidup yang meningkat dan mendapat gaji yang bermaruah.
3.Adalah penting untuk mengurangkan jurang pendapatan antara kaya dan miskin. Juga tidak dapat dinafikan bahawa 20% orang kaya menikmati 51% jumlah pendapatan negara manakala 10% miskin hanya menikmati 1.7% dari jumlah pendapatan Negara.
4.Meningkatkan kuasa beli para pekerja dan boleh mendatangkan kebaikan kepada pasaran domestik.


Alasan-alasan seperti pelabur akan lari, majikan akan muflis, pekerja akan malas, kerajaan akan bankrupt, semuanya retorik dan tidak benar. Apabila Kerajaan Selangor yang budget tahunannya hanya RM1.5 billion dapat mengimlimentasi Gaji Minima RM1500 di syarikat-syarikat GLC dengan menyumbang subsidi bagi syarikat-syarikat tersebut, kenapa Kerajaan Persekutuan yang budget tahunan RM200 bilion tidak dapat laksanakan Gaji Minima?

Persoalan di sini, adakah kerajaan betul-betul berniat untuk melaksanakan Akta Gaji Minima supaya warga pekerja di Malaysia dapat hidup secara bermaruah ataupun ini satu lagi gula-gula pilihanraya untuk meraih undi di PRU Ke-13.

Forum : Hala Tuju Politik dalam Memperjuangkan Hak Pekerja



Hari ini, Jaringan Pekerja Malaysia yang terdiri daripada beberapa kesatuan-kesatuan sekerja, kumpulan masyarakat dan NGO telah menganjurkan satu forum berkenaan hala tuju politik dlaam memperjuangkan hak pekerja.




Lebih kurang 60 orang telah hadir ke forum ini. Isu utama yang dibincangkan adalah mengenai hak-hak pekerja yang semakin terhakis dibawah pimpinan kerajaan BN dan tindakan yang diambil untuk memperjuangkan hak pekerja.





Antara speaker yang dijemput adalah Sdr. Muhendran dari Bar Council, Sdr. Razak dari Kesatuan Pekerja-pekerja KTMB, YB Charles Santiago ahli parlimen Klang dan Dr. Jeyakumar, ahli parlimen Sg. Siput.

A BLOW TO GENDER EQUALITY!
Appeal court’s appalling decision

Parti Sosialis Malaysia (PSM) would like to express its total disappointment with the Appeals Court unanimous decision today in dismissing the application of eight women workers from Guppy Industries.

The three-man bench led by Datuk K. N. Segara was dim-witted as they acted like an apologist to the employer. The judge further went to ridicule and suggest that this case has nothing to do with gender inequality, discrimination nor constitutional rights. Two human – one male and one female;, having two retirement age and not supported by any rationale argument except that other factories practice this, yet for the learned judge this is not discrimination.

Once the court said that the appeal was dismissed, the affected workers rightfully walked out and were not ready to hear the judges explanation. This was because during the entire court proceeding, the Judge was acting in such a bias manner that his verdict was predicted.

Datuk K.N. Segara seems to imply that whatever the employer says even if it is not backed with scientific evidence should be alright as long as it comes from the employer. He dismisses that Industrial court verdict which said that the burden is with the employer to prove that these workers cannot work beyond age 50.

What was so blatant about this judgment is that a rule book in which this new discrimination law was stated was actually introduced very much later after they were employed. The Judge felt that it is fine to introduce these new laws half-way even though the Union and workers then protested against it. The unintelligent judge also told the lawyer that he needs to help the workers form Unions not realizing that the entire union leadership was sacked by the employer when they found out that they were forming a Union.

The Guppy employer dismissed the workers at the age of 50 but offered them all reemployment as contract workers. By employing them as contract workers, the workers will lose more rights and benefits since they were previously permanent workers. By employing them again simply means that the women workers were still capable of working beyond 50 and he even employed one of the worker at the age of 50. The lawyers for the workers, Ragunath Kesavan also showed proved that out of the 29 workers reemployed above 50 years old, 26 were women which is around 90%. This fact itself is enough to justify that the employer was pulling a fast one when he said women workers cannot perform after the age of 50. But all this points seems to fall on the deaf ears of the learned judge who says the company followed practices of other Industries.
The Industrial court which initially ruled in favor of the workers said that this Guppy Union policy was stone age practice and slammed the employer and called the termination unlawfully. Today the Appeal court judges seem to justify these Stone Age discrimination policies.

It was truly blatant that employers can get away with this. What do you expect if we have dumb judges who are themselves bias and do not have a clue what is Article 8(2) of the Federal Constitution and CEDAW (Convention on the Elimination of Discrimination against Women)

The workers will now bring their matter to the Federal Court hoping that sanity still exist in our courts.
