Socialism the way forward

Often the frustration felt by the left when organizing public talks and sessions is that we are speaking to the converted. There is a feeling we have not progressed very much. But there was a refreshing and reassuring change this time at the Socialism 2011 conference organized by the Parti Sosialis Malaysia on 20/11/11 at the Selangor Chinese Assembly Hall in Kuala Lumpur.


The conference themed Socialism – An Alternative for Malaysia, and organized for members of the public, saw a turnout of over 150 people, and what was exciting was the significant number of new faces among the participants. It was an indication of the disenchantment of thinking Malaysians with the current state of affairs in the country, and of the loss of faith in the existing system. This is the disenchantment that brought thousands to the streets for BERSIH, and that is making people identify with the worldwide ‘We are the 99%’ and the ‘Occupy’ movement. There is a search for an alternative. Faith in the capitalist system has been steadily eroding with the bitter experience of worsening economic hardship, bailouts of the rich, the sickening corruption of the ruling elite, and a system of governing that is akin to a circus.


The socialist system as an alternative seemed the most timely theme for the PSM which had managed to emerge somewhat shaken but intact from the government’s infamous use of the Emergency Ordinance on six of its leaders. The role of the rakyat nationwide in pressurizing the government to release the six was unprecedented especially given the government’s use of the communist bogey to criminalise the Parti Sosialis Malaysia. It showed that the rakyat had matured and could no more be dictated to by an irrational government whose credibility was a question mark. We felt that the socialist conference for the year should enlighten people about the concerns of socialists on the question of socialism as an alternative for Malaysia, the economic system and cultural policies that are envisaged.


The first panel on the topic Has Malaysia Prospered Under Capitalism? comprised of three interesting speakers from different backgrounds. Sdr Wan Saiful from IDEAS, argued that in Malaysia we don’t have full-fledged capitalism yet due to too much of government intervention, and that therefore the failures cannot be blamed on the capitalist system! The next speaker, Prof Dr Terence Gomez outlined the shortcomings of the system and argued for the institution of more social democratic programmes to enlarge the safety net and better governance. Dr Jeyakumar, the socialist MP of Sg Siput started off by talking about the achievements of capitalism in Malaysia as compared to other post-colonial societies, but how these are far outweighed by the failures, and that since global capitalism has entered a long period of decline, countries like Malaysia have to move towards a socialist economy.


The second panel saw our special guest, Sdri Melanie Barnes of the Socialist Alliance of Australia, and PSM central committee member Sdr Choo Chon Kai presenting on the topic, Is the Socialist Economic Model A Viable Alternative? Critique of the Previous Socialist Models. They gave a critical analysis of previous models and held up Venezuela and Yugoslavia as models we could look at.The third speaker, Sdr Premesh Chandran, CEO of Malaysiakini, gave an energetic presentation of how we should be innovative and not wait to take political power before embarking on ‘socialist’ economic ventures. He outlined several online incentives that could benefit socially useful projects.


Panel Three on the topic, Is Socialism Practical In a Multi-cultural Society like Malaysia? Freedom and Full Human Development discussed the merits and suitability of the socialist system in a multi-cultural context. Though it was the difficult post-lunch session, the quality of the presentations kept everyone focused and attentive. Sdr Ahmad Fuad from Islamic Renaissance Front argued very convincingly that cultures have to be understood dialectically and not as "things" that were discrete and separate. He proposed that the different cultures in Malaysia all have revolutionary and humanising aspects which are congruent. He argued that we have to "indigenize" socialism to make it more recognizable to the Malaysian people. Sdr Hishamuddin, analysed the development of the Malaysian nation in a humorous yet provocative and insightful manner. His witty repartees to Sdr Jeyanath (SABM) who had a challenging time trying to keep to time, had the audience in stitches! Hisham emphasized that we have not solved the National Question and it keeps coming back. Sdri Rani Rasiah of the PSM argued that the socialist system with its objective of full human development in a classless society was the practical alternative to the capitalist system that was exploitative and used ethnic differences to divide and rule.

The conference came to a close after the fourth panel presentations on the topic, Socialism ala Malaysia. Sdr Boon Kia Meng the first speaker gave a spirited presentation on the topic and offered many ideas about the concrete actions that can be taken by socialists in Malaysia. "Who are the proletariat in KL?" he asked the audience. Kia Meng suggested that all those who contributed building of KL should be considered the Proletariat and that they have the right to have a say how the city was being run. "We should take back the city," he urged.The other panelists were Sdr Arif Abdull of Durian FM, Sdr Chong Ton Sin of Gerak Budaya and the PSM Secretary General, Sdr Arulchelvan who reflected that just a short 13 years ago, when the PSM was launched, many friends said that it was a suicidal move to call ourselves socialist, but now many people the world over are turning to socialism for answers. Arul reminded us that the shift from capitalism to socialism is a process and the tactics undertaken should recognize that fact.


Overall the conference saw a vibrant discussion of ideas, with many questions and comments from members of the audience. It seemed highly relevant to the socio-economic upheavals and the search for alternatives taking place outside the conference room, in Malaysia and abroad.

Bengkel setiausaha dan bendahari ke 3 PSM








Bengkel untuk Pengerusi, Setiausaha dan bendahari telah diadakan di Kota Damansara dihadiri oleh 50 orang pemegang jawatan tersebut. Latihan bengkel dikendalikan oleh beberapa orang aktivis PSM seperti Sdr Suresh,. Letchimi dan Kris Kaira.

Bengkel dirasmikan oleh Pengerusi nasional PSM Dr. Nasir Hashim. Latihan tahun ini meliputi selain dari latihan kemahiran SU dan BH adalah bagaimana berfikir di luar kotak, bagaimana bekerja dengan ahli yang sedikit dan menggunakan beberapa teknologi baru seperti email.

Rajakumar - Pejuang sosialis berjiwa rakyat







Hari ini saya pergi pelancaran Buku Rajakumar - an uncommon hero> Seorang kawan baik MK Rajakumar, Kai Hee bekas Setiausaha Agung Parti Buruh berkata ada orang hidup tapi mati manakala ada orang akan terus hidup walaupun mati. Kategori kedua adalah Rajakumar

Dr M.K. Rajakumar (25 May 1932 - 22 November 2008) was a veteran socialist leader and medical practitioner, regarded as a founding father of the discipline of family medicine by general practitioners and family physicians.

As a leftist intellectual he formed part of the leadership of the Labour Party of Malaya and Barisan Sosialis during the 1960s. He helped build the Labour Party with other leaders like the late Tan Sri Dr Tan Chee Koon, David V., Ishak Haji Muhammad (better known as Pak Sako) and Karam Singh.

Early involvement

In the 1950s, Rajakumar was active in the Socialist Club while studying medicine at the Singapore campus of University of Malaya where he met historian Prof Emeritus Tan Sri Dr Khoo Khay Kim and former Parti Sosialis Rakyat Malaysia Kassim Ahmad, who were also students.

Rajakumar, then 22 years old, was involved with the editorial board of Fajar, which was the Socialist Club’s newspaper. The team behind the newsletter were soon accused of sedition and involved in a court trial. Rajakumar and The Fajar team were defended by the legendary radical British Queen's Counsel DN Pritt, with Lee Kuan Yew (who later became the first Prime Minister of Singapore) as junior counsel.

He then moved on to be chairman of the Selangor Labour Party and was always very dedicated. He was detained under the Internal Security Act from 1966 to 1969.

Politically, his influence waned after the decline of the Barisan Socialis in the late 60s but he always held on to his ideals.

Jamuan Deepavali MPP ZON 18

Hari ini, Jamuan Deepavali MPP ZON 18 telah diadakan dengan penuh meriah di Taman Manikavasagam. Jamuan ini dianjurkan oleh Sdr. Arul bersama Persatuan Penduduk Taman Manikavasagam.




Wakil-wakil dari MPP ZON 18, Ketua-ketua Kampung serta para penduduk di Semenyih, Kajang, kawan-kawan NGO serta orang ramai telah hadir ke jamuan ini. Jamuan Deepavali juga bertambah meriah dengan kehadiran kawan-kawan Muslim yang menyambut Hari Raya Korban hari ini.



Dianggarkan lebih 500 orang telah hadir ke majlis ini. Makanan yang ditempah telah habis dan terpaksa dibeli. Walaupun kedai-kedai makanan yang berdekatan telah ditutup, pihak penganjur berjaya membeli makanan tambahan di Semenyih.






Ucapan-ucapan turut disampaikan oleh wakil-wakil MPP. Di Majlis ini juga, semakan daftar undi telah diadakan. Ramai orang mengambil kesempatan untuk mengetahui kawasan undi mereka.



Syabas kepada Persatuan Penduduk Taman Manikavasagam yang berjaya menganjurkan Majlis Deepavali ini.

4 Ekar Tanah untuk Deepavali : Cahayakan Ladang Bukit Jalil

Hari ini, para penduduk Ladang Bukit Jalil telah mengadakan jamuan Deepavali. Jamuan ini diadakan bersempena kempen 4 ekar tanah untuk Deepavali : Cahayakan Ladang Bukit Jalil. Lebih 200 orang yang terdiri daripada Ahli-ahli Parlimen dan DUN, kawan-kawan NGO, saudara-mara dan individu-individu telah hadir ke jamuan ini untuk memberi sokongan solidariti kepada para penduduk Bukit Jalil yang memperjuangkan hak perumahan mereka.




Ucapan solidariti telah diberikan oleh YB Mano, Saudari Fadiah dan juga Sdr. Arul. Jamuan dimeriahkan lagi dengan persembahan lagi "Acham-Acham Illai, Ini Adimai Ennam Illai" oleh anak-anak muda.










































































Mesyuarat MPP terus bincang isu sistem kontrak baru sampah




Hari ini kita terus berbincang masalah-masalah yang dihadapi setelah MPKJ ambilalih sepenuhnya pengambilan sampah daripada kontrakter Alam Flora. Nampaknya ada masih banyak lagi masalah yang perlu dibereskan. S.Arutchelvan sebagai Ahli majlis memberi syor akan memberi nombor hubungan pemantau MPKJ untuk memastikan sampah pukal dikutip sebulan sekali dan meminta Persatuan Penduduk memantau isu ini dari dekat.

Ramai yang tidak sedar bahawa parti tertua masa kini yang diasaskan oleh Ahmad Boestaman masih ada. Hari ini dibawah kepimpinan Rohana Arriffin, PRM cuba mengaktifkan semula setelah lama keliru ekoran gabungan dengan Parti Keadilan Nasional.

Hari ini mereka merayakan hari jadi parti tersebut di Pejabat Parti di PJS.

SAMBUTAN TERBUKA KEMENANGAN 3 WIRA: ROSHAMIZA, KOYILVANI & KANNIAMAH-PENGASAS KESATUAN SEKERJA GUPPY PLASTIC INDUSTRIES

Pada 14 December 2009, Mahkamah Tinggi Kuala Lumpur mendapati pembuangan kerja 3 pemimpin Kesatuan Guppy ini adalah tidak adil, terlalu keras dan salah! Satu kemenangan besar kepada pekerja-pekerja ini yang telah menghadapi pelbagai ancaman dan gangguan dari majikan mereka sejak kesatuan sekerja di tubuhkan pada tahun 1998.

Kesatuan Pekerja-pekerja Guppy Plastik Industries Sdn Bhd yang didaftarkan pada 27 April 1998 adalah unik kerana keseluruhan kepimpinannya terdiri daripada wanita. Namun mereka digeruni oleh pihak syarikat sehingga

· Pengerusi Kesatuan, Sdri. Koyilvani dipecat kerja dalam masa 24 jam atas tuduhan melakukan aktiviti-aktiviti ‘anti-syarikat’ pada 18 Jun 1998

· Penolong Pegerusi, Sdri Rahimah digantung kerja 2 kali, pada 4 Jun 1998 dan 25 Ogos 2001

· Setiausaha, Sdr. Roshamiza dipecat kerja dalam masa 24 jam atas tuduhan melakukan aktiviti-aktiviti ‘anti-syarikat’ pada 18 Jun 1998

· Bendahari, Pn. Kanniamah dipecat kerja dalam masa 24 jam atas tuduhan melakukan aktiviti-aktiviti ‘anti-syarikat’ pada 18 Jun 1998.

· Penolong Bendahari, Visaletchumy digantung kerja 2 kali, pada 4 Jun 1998 dan 25 Ogos 2001

Tuduhan-tuduhan palsu dilemparkan ke atas mereka, antaranya memaksa pekerja menyertai kesatuan dan menyalahgunakan wang sehingga polis dibawa masuk untuk menangkap 2 orang pegawai kesatuan tersebut. Lebih daripada 20 aduan di buat kepada Jabatan Perhubungan Perusahaan (JPP) oleh pihak kesatuan terhadap pihak majikan yang memangsakan ahli-ahli kesatuan.

Pada 24/6/1998 hampir 100 pekerja Guppy menandatangani petisyen membantah pemecatan 3 pegawai kesatuan tersebut.

Sokongan pekerja-pekerja ini telah menguatkan lagi semangat pemimpin-pemimpin kesatuan yang telah meneruskan perjuangan mereka selama ini. Beberapa kemenangan hasil perjuangan kental pekerja-pekerja ini ialah:

· 2 pegawai kesatuan yang digantung kerja menang kes di Mahkamah Perusahaan pada 5/1/2006 dengan masing-masing menerima pampasan tapi mereka dilarang mengumumkan jumlah yang diterima kepada awam!

· Kesatuan memfail kes di mahkamah perusahaan terhadap Guppy Plastic Industries yang memangsakan ahli-ahli kesatuan. Kesatuan menang. Pada 4/12/2007, presiden Mahkamah Industri, Dato Umi Kalthum bin Abdul Majid mengumumkan, “Whether you like it or not Mr. Goh (the management), trade unions are here to stay, and you have to accept the existence of the Kesatuan Pekerja pekerja Guppy Plastic Industries”.

· Kempen membantah pelaksanaan Buku Panduan Syarat-Syarat & Peraturan Pekerjaan pada tahun 2000 yang bercanggah dengan Akta Pekerjaan 1955 dan Perlembagaan Persekutuan Negara. Antara isu-isu tersebut ialah berkaitan notis penamatan, waktu bekerja, dan diskriminasi umur persaraan antara lelaki dan wanita. Perkara ini di bawa ke perhatian JPP, JB dan KSM.

· Pada 6-5-2008 pula dalam Kes Pemangsaan Kesatuan, mahkamah meminta majikan memberi lebih ruang kepada kesatuan untuk berfungsi termasuk menyingkirkan peraturan-peraturan dalam Buku panduan pekerja yang menghalang aktiviti kesatuan. Pekerja migran boleh jadi ahli kesatuan. Majikan setuju untuk membina hubungan dengan Jawatankuasa Kesatuan (Baru).

· Jun 2001, 30 pekerja wanita dihentikan kerja dalam masa 24 jam, kononnya mereka sudah mencapai umur persaraan, 50 walhal ketika itu umur mereka lebih daripada itu! Kesatuan fail kes di JPP untuk 9 orang pekerja dimana mereka menang di Mahkamah Perusahaan [No. 26 (14)/4-244/05, Award No. 1147]. Pada 18/4/2008, Pengerusi Mahkamah Industri Rajandran Nayagan berkata “The Industrial Court will show the way and make a ruling which will be useful to society “ Do you know how a civilized society is gauged? It is gauged by how it treats women in society.”

Namun mereka kalah di Mahkamah Tinggi, kini kes di Mahkamah Rayuan.

KES KEMENANGAN 3 ORANG PEMIMPIN KANAN KESATUAN SEKERJA GUPPY

· Pada 27 Apr 1998, tujuh orang wanita berani telah memulakan satu kesatuan Sekerja untuk membela nasib pekerja yang menghadapi pelbagai masalah anataranya gaji rendah

· Pada 4 Jun 1998, kesemua 7 orang daripada mereka digantung kerana dikatakan menjalankan aktiviti anti Syarikat pada hal sebenarnya mereka digantung kerja kerana terlibat dalam menubuhkan Kesatuan Sekerja

· Pada 18 Jun 1998, tiga orang pemegang utama iaitu Koyilvani (bekerja di Guppy sejak 4/7/1989), Roshamiza (sejak 12/4/1993) dan Kanniamah (sejak 16/7/1991) telah disingkirkan terus tanpa diadakan sebarang siasatan dalaman (domestic inquiry)

· Pada 30/9/1998, kes ini telah dirujuk ke Mahkamah Perindustrian.

· Setelah beberapa kelewatan, akhirnya kes mereka dibicarakan buat kali kedua bermula pada 26 Julai 2004 dihadapan Pengerusi Mahkamah preindustrial Puan Soo Ai Lin.

· Mereka akhirnya kalah pada 31 Mei 2006 di mahkamah Perindustrian

· Mereka membuat rayuan pada 19 July 2006 di mahkamah tinggi dimana peguam mereka adalah Edward Saw Keat Leong.

· Perbicaran kes di mahkamah tinggi kemudian berlaku dan mereka akhirnya mendapat kemenangan pada 14 Dec 2009 apabila Hakim Mahakmah Tinggi Mohamad Ariff bin Md. Yusof memutuskan mereka menang dan merujuk kes balik ke Mahkmah Perindustrian untuk pengiraan pampasan dan gantirugi,

· Walaupun mereka menang, tetapi majikan mula mengertak mereka dan berkata dan meminta mereka mengambil peratusan yang kurang dan merahsiakan kemenangan mereka dan jika mereka enggan merahsiakan kemenangan mereka, maka Syarikat akan membuat rayuan di mahkamah rayuan dan ini mungkin akan mengambil lebih masa lagi

· Pada 30 Okt 2011, 3 orang pekerja ini merasakan bahawa pembuangan kerja mereka adalah tidak sah.

· Mereka merasakan bahawa kemenangan mereka mesti dihebohkan kerana akhirnya mahkamah Tinggi menyebelahi mereka .

Kes ini amat signifikan

1. Kerana mengatakan seorang pekerja yang dibuang kerja, hanya mampun mendapat pembelaan selepas 13 tahun dan itupun belum tentu

2. Amalan memangsakan pemimpin Kesatuan Sekerja amat ketara dan berleluasa tetapi isu ini tidak diberikan keutamaan yang sewajarnya

3. Tiga orang wanita biasa ini membuktikan kepada Syarikat mereka yang cuba membuli mereka dan memeras mereka bahawa mereka tidak boleh diumpan kerana wang sahaja. Mereka mempunyai maruah dan harga diri. Wang bukan segala-galanya dan hari ini mereka memberanikan diri dan memberi satu mesej yang cukup jelas bahawa kaum pekerja mesti berani melawan Majikan mereka yang sanggup membelanjakan beribu-ribu ringgit hanya kerana beliau tidak mahu satu Kesatuan Sekerja di kilangnya.

4. Syarikat-syarikat ini juga mendapat pembelaan dari Undang-undang buruh yang tidak pro pekerja
